Section 360-11.4 Enrollment options for MA recipients having established treatment
relationships with providers of special care.
(a) An MA recipient who has an established treatment relationship with
a provider of special care may:
(1) participate in an MCP and be enrolled with
a health services only managed care provider;
(2) participate in an MCP and receive special
care through the MCP provider network; or
(3) choose not to participate in an MCP.
(b) An MA recipient who has an established treatment relationship with
a provider of special care and is not otherwise excluded from participating in an MCP is
not required to participate in an MCP in which participation is mandatory and will be
presumed not to choose to participate in such a mandatory MCP unless the recipient applies
to participate.
