On May 22, 2014, DOH provided Consumer advocates with drafts of notices regarding passive enrollment in FIDA to begin fall 2014. This is the Consumer coalition's proposed revision of NOTICEs 3 and 4 (60-day and final 30-day notices before Passive Enrollment).

The NYS Dept. of Health's notice sent by its contractor, NY Medicaid Choice (Maximus) 30-days prior to "passive enrollment" into a FIDA plan. This notice follows an "announcement" notice (https://www.health.ny.gov/health_care/medicaid/redesign/docs/fida_prog_announce_brooklyn.pdf) a 90-day and 60-day notice. Both the 60-day and 30-day notices tell you which FIDA plan you will be assigned to if you do not OPT OUT.

Issues include enrollment of nursing home residents and protections; objections to "passive enrollment" -- auto-assignment of people who don't voluntarily enroll; and incentives for plans to provide long term care services in the community rather than institutions.

After the Federal CMS agency entered a "memorandum of understanding" with NYS to approve the FIDA proposal to manage care for Dual Eligibles, a 3-way contract had to be approved between the State, the Feds and the FIDA plans. THis is the consumer coalition's comments on what protections are needed in this contract.
